Call for papers - Bilingual Symposium “Palestine and international criminal and humanitarian law”

Since the attacks carried out by Hamas in Israel on 7 October 2023 and the Israeli military escalation in Gaza that followed, the war of words and political debates have prevailed to the detriment of international law. The propagation of different positions presented as legal arguments has widely invaded social networks and the media. These positions are not only dangerous, but above all, for many, erroneous.

The recent events are taking place in the context of an armed conflict that has been going on for several decades and is marked by systematic violations of the rights of the Palestinian people, as well as violations of international humanitarian law by both sides.

Since 2009, the UN has established five investigative bodies tasked with examining allegations of human rights violations and violations of international humanitarian law in the occupied Palestinian territories, including East Jerusalem, and in Israel. Despite their conclusions confirming violations committed by both parties and emphasizing the need to hold the responsible parties accountable, no concrete action has been taken.

So far, the action of the International Criminal Court (ICC) has been measured. On 1 January 2015, the Palestinian Government filed a declaration recognising the ICC's jurisdiction over alleged crimes committed "in the Occupied Palestinian Territory, including East Jerusalem, since 13 June 2014". And on 2 January 2015, Palestine acceded to the Rome Statute. In 2021, the Prosecutor opened an investigation, but no arrest warrant has been issued to date.

This Symposium aims to explore the legal framework applicable to the Israeli-Palestinian conflict, particularly the violent events following 7 October. It aims to create a platform allowing scholars, young researchers, experts, and practitioners to highlight the major challenges facing international humanitarian law and the fight against impunity for crimes committed in the context of this conflict.

We invite contributions (in French and English) addressing topics such as:

  • Occupation and international humanitarian law

  • The right to armed resistance and its limits

  • The distinction between jus ad bellum and jus in bello

  • The protection of the civilian population in armed conflicts

  • The International Criminal Court and the situation in Palestine

  • Commission of war crimes, crimes against humanity, and genocide

BDIP is also open to articles addressing other subjects.

Guidelines for submitting contributions

To participate in the Symposium, interested individuals are invited to submit their article in French or English (maximum of 2,500 words), an abstract (150 words), and a short biography (200 words) following the blog procedure (accessible here: https://www.blogdip.org/soumettre-un-article) before 1 December 2023. The editorial committee will evaluate the submitted proposals and select between six and ten proposals.

Candidates will be informed of the acceptance or rejection of their proposal within a few days of submission.

The final publications will be hosted on BDIP from 15 December 2023.

We encourage authors to submit articles addressing all branches of international law, including international human rights law, international humanitarian law, international criminal law, and transitional justice.
